Robert Chemers and Scott Howie won an appeal for an insurer client in the Appellate Court of Illinois, Second District, on an issue of first impression involving an insurer’s Customer Complaint Defense Reimbursement Coverage endorsement on an auto dealer’s policy which provided for reimbursement of reasonable defense expenses incurred for the defense of a customer complaint involving the selling, servicing or repairing operations of the dealer, however, there was an exclusion for intentional conduct. The Appellate Court found that the circuit court erred, and reversed and remanded to the circuit court for entry of judgment for the insurer client.
