Robert Chemers and Rich Burgland won a summary judgment for a professional liability insurer that it had no duty to defend its insured personal injury attorney who along with his employee, who had been an officer of an existing business, allegedly surreptitiously obtained confidential information and trade secrets from the existing business which they used to create a competing business, and then were sued by the existing business for breach of fiduciary duties, tortious interference with contract and with business relations, violations of the Illinois Trade Secrets Act and conspiracy. The Court found no duty to defend based on a lack of allegations of “professional services” as lawyers.
