Pretzel & Stouffer Attorneys Sustain Summary Judgment on Appeal in Substantial Injury Case Involving Borrowed Employee

Pretzel & Stouffer trial lawyers Edward Ruff and Suzanne Crowley obtained summary judgment for their client, and firm appellate lawyer Scott Howie obtained affirmance of that judgment on appeal, in a recent case finding that the plaintiff, who had a traumatic amputation of his arm below the elbow while operating a lathe, had an exclusive remedy under the Workers’ Compensation Act and was barred from filing suit.

The decision, France v. Graphic Packaging Int’l, Inc., 2018 IL App (1st) 180347-U, clarifies the limited role of a contract between a loaning employer and a borrowing employer in determining if the employee is covered by the exclusive-remedy provision of the Act.
