Multi-Million Dollar Lawsuit Against Estate and its Administrator Dismissed
The team of Jim Sipchen, John Scheid, and Rachel Grajewski recently won a dismissal of a lawsuit brought in the Circuit Court of Cook County against an estate and its administrator that sought recovery of over $4 million for alleged breach of fiduciary duty, breach of contract, undue influence, and unjust enrichment. The plaintiff contended that he and his father, now deceased, were business partners, and during the decedent’s lifetime, plaintiff had loaned his father $4 million which now had to be repaid by the estate and/or the administrator personally. The court dismissed the lawsuit based upon the defense team’s legal arguments that concentrated upon the contents of numerous tax records which demonstrated that not only had plaintiff failed to plead the existence of a loan, but also, that a loan likely could never be shown. The strength of the motion, argument, and order of dismissal entered resulted in plaintiff subsequently abandoning his case completely.
