Motion to Dismiss Granted in Legal Malpractice Action

Matthew Egan, recently secured dismissal with prejudice of an attorney who represented a group of investors in a large commercial real estate development.

The plaintiffs alleged that the attorney was negligent in structuring several corporate and real estate transactions, causing the investors to be exposed to personal tax liability for millions of dollars in TIF payments the project received from the local government that had approved the development. Matt successfully challenged the plaintiffs’ initial complaint as well as their first and second amended complaints with motions to dismiss on multiple legal grounds, resulting in the client being dismissed from the case with prejudice.
