Mike Barry and Jennifer Sutterer secure victory for a urologist, medical group and Chicagoland hospital
We are proud to announce that Michael Barry and Jennifer Sutterer secured a not guilty verdict on behalf of a urologist, medical group, and Chicagoland hospital in a complex medical malpractice trial in Cook County. The plaintiff alleged that a prostate cancer treatment known as brachytherapy was contraindicated due to an undiagnosed neurogenic bladder and known outlet obstruction, and that the procedure caused immediate and permanent urinary retention requiring self-catheterization six times per day since 2017. Plaintiff sought $3.5 million in damages. The defense established that there was no evidence of a neurogenic bladder at the time of treatment, that the procedure was properly indicated and appropriately performed, and that the plaintiff’s condition was attributable to a neurogenic bladder and later-diagnosed outlet obstruction unrelated to the procedure. The team further demonstrated that a reasonable urologist would not have anticipated chronic urinary retention based on the plaintiff’s underlying urinary symptoms. The jury returned a defense verdict in under one hour.
