Firm Obtains Three Consecutive Victories For Employer In A Series Of Contentious Employment Matters
Jim Sipchen and Matthew Ligda recently accomplished a rare feat in obtaining dismissals of three separate cases brought against a medical supply company and its principals by a former employee.
In his first lawsuit, the former employee alleged that the defendants violated his privacy rights when addressing a complaint another employee made regarding the amount of the former employee’s salary. After a motion to dismiss was filed, plaintiff voluntarily dismissed this lawsuit only to file a new claim with the Illinois Department of Human Rights (“IDHR”) alleging employment discrimination under Title VII of the Civil Rights Act. Jim and Matt obtained an administrative dismissal of this claim after a fact-finding conference, but plaintiff filed yet a third lawsuit in state court alleging intentional infliction of emotional distress. After extensive briefing and amendments of the pleadings, the court dismissed this third lawsuit with prejudice, thus putting an end to plaintiff’s successive filings.
