Pretzel & Stouffer partners Brian Sundheim and Kelly Kono obtained summary judgment for their client, a psychiatrist, in a case pending in Winnebago County.

The pleadings alleged violations of the Illinois Mental Health and Disabilities Code and “false imprisonment”, for “involuntary” hospitalization of a patient who had been brought by Rockford paramedics to OSF Saint Anthony’s Hospital after being found unconscious, intoxicated, and naked in a church basement with an empty container of prescription medications by her side.

The Court found that the psychiatrist’s treatment decisions comported with the Illinois Mental Health and Disabilities Code and the psychiatrist had immunity from liability under 405 ILCS 5/6-103(a) of the Code.
