Summary Judgment Obtained for Business Owner Defendant on Personal Guarantee
Jim Sipchen, obtained summary judgment on behalf of a client sued on a personal guarantee. The client had formerly been a co-owner of a restaurant, who had been ousted from the business by its majority shareholder, but at the time the business was formed had signed a number of personal guarantees relating to a number of matters including the restaurant’s lease. Jim successfully argued that the guarantee was no longer valid due to changes in circumstances in the parties’ relationships. Jim also successfully defended the client in a suit filed over the breakup of the business in which Jim successfully advocated claims of wrongful oppression of a minority shareholder on behalf of his client.
